Amended provisions of section 148,whether applicable with retrospective effect [Surinder Singh Deswal @ Col. S.S. Deswal and Others Vs. Virender Gandhi]
Section 148 as amended, shall be applicable in respect of appeals against order of conviction and sentence for offence under section 138, even in a case where criminal complaints were filed prior to Amendment Act No.20/2018 i.e prior to 1-9-2018
